Q. In the Occupational Health And Safety Act, (Industrial Establishments) Section 23 clearly outlines the duties of employers and other persons. In the event a company is charged under any section of the act, how much can a company be fined?
A. The maximum fine for charges laid under the Occupational Health Safety Act is $500,000.00. These fines are public information and can be found at

www.gov.on.ca/lab/english/news/

A good exercise for Health and Safety staff, (and employers) is to periodically review the most recent fines and see how they reference the section of the act that was contravened. Take a look and see if your company is being compliant with the Occupational Health And Safety Act. This exercise may help save a life and of course save your company thousands of dollars. The collateral damage of your company having a critical accident can be disastrous.

Training may seem expensive to some, however, practicing due diligence and taking a pro-active approach to Occupational Health And Safety may save your company thousands. Seeing the actual fines that have been imposed for not providing training should help influence your attitude towards training as being an “investment” not an “expense”!
