Q. We are required to leave the seat of our lift truck when the load is raised on a regular basis. Is this safe, or are we breaking any laws?

A. Good question. Although it is public knowledge I will not name the company, but here is a recent fine posted on the MOL site.
Company fined $135,000 for health and safety violation resulting in death of a young worker
On July 21, 2005 a general labourer sustained fatal injuries when crushed by a heavy metal hopper. The young worker was using a forklift truck to empty the hopper containing 805.13 Kilograms (1,175 lbs) of waste into a dumpster. The procedure in use at the plant required workers to leave the seat of the forklift to pull a short chain to empty the hopper, leaving the controls of the truck unattended. The truck was found on its side with the victim under the hopper basket.
The defendant pleaded guilty, as an employer, to failing to ensure that a lifting device was operated in such a way that when its load was in a raised position its controls were attended by a n operator as required by Section 51(2)(b)(iii) of the Regulations for Industrial Establishments. The was contrary to Section 25(1)(c) of the act
