Q. I work construction and I can’t help notice that the scissor lifts on site seem to become community property and gets used by people that have no idea what they are doing. Who is going to be responsible if one of these guys gets killed or has an accident?
A. This is something that I witness on a regular basis and it really, really, really upsets me. We don’t have enough space for me to answer that question. The long and short of it is that an investigation would have to take place. Pending the outcome of the investigation the MOL would decide who to charge. I can tell you from MOL case history on their website that when you allow someone to use your equipment, they can actually be deemed to be your employee. If the lift is owned by your company, they may be held liable. I’m not a lawyer nor do I have a legal background. I can only answer questions based on case history. Every case is different pending the outcome of an investigation.
